What licenses are required to apply for local factories in Thailand

To legally operate a factory in Thailand, the following four documents must be applied for in accordance with the Factory Law: 1. Industrial land permit, 2. Factory building permit, 3. Factory acceptance permit, and 4. Factory commencement permit. All four documents need to be applied for one by one, and the application and approval process takes about 6-12 months. If the enterprise is leasing a factory, only the industrial land permit and factory commencement permit need to be applied for, while the building permit and acceptance permit are applied for by the factory owner.

Industrial land permit is simply understood as the land use permit for enterprises to purchase industrial land. It is the first industrial zone certificate that a company needs to apply for after registration. After obtaining the land use permit, the company gradually applies for the following three documents. The main preparation documents are as follows:
1. Application Form for Land Use Permit KOR NOR OR 01/1;
2. Registration certificate and shareholder register (valid for 6 months);
3. Copy of the legal representative's passport/work permit;
4. Plot drawings;
5. Copy of land deed;
6. Land purchase or factory lease agreement;
7. Product process flow;
After the above documents are prepared, each page shall be signed and stamped by the legal signatory (passport signature without stamp). After completion, they shall be submitted to IEAT for approval, and it will take about 30 days to complete the processing with complete documents.

Precautions:

1. Before filling out the form, information on electricity, water, sewage, production waste, household waste, production capacity, raw materials, finished products, domestic and international sales ratios, working hours, process flow, etc. during the initial and final stages of the project must be provided.
2. The company registration certificate and shareholder register have time limits when handling government applications or bank affairs. If they expire, they need to be updated at the local commerce department.
3. After the company registration is completed, it is necessary to sign the sales or lease contract in a timely manner, otherwise it will affect the subsequent document application work. Without the contract, it is impossible to submit the land permit application.
4. After the land permit is approved, further application for land ownership certificate can be made. After the ownership is approved, the company documents, legal person certificates, land payment invoices, land deeds, and ownership certificates can be prepared and processed at the land department in the area where the land belongs.

Factory building permit refers to the certificate approved by the industrial zone management bureau that allows enterprises to build factories on the purchased land, provided that the land use permit is obtained before submitting the building permit. The main preparation documents are as follows:
1. Five application forms for building permit KOR NOR OR 02/1;
2. 5 copies of registration certificate and shareholder register (valid within 6 months);
3. Five copies of the legal representative's passport/work permit;
4. Five industrial land permits;
5. Three copies of A1 architectural drawings;
2 sets of A3 architectural drawings;
The design company used by the enterprise will assist in preparing and applying for the above documents. The complete documents will be signed and stamped by the legal signatory on each page (passport signature without stamp) before being submitted to IEAT for approval, which takes about 30-60 days to complete.

Precautions:
1. If the registration certificate and shareholder register expire, they need to be updated before submission.
2. It is best to submit the final version of the architectural drawings in one step, as any changes to the drawings require further updates and submission, which will prolong the application period and affect subsequent document applications.

    If the construction is not carried out according to the drawings, there will be problems in the subsequent factory acceptance. Returning the approved building permit and the declared building drawings will increase the workload and workload of the design company and the enterprise itself.

Acceptance permit refers to the acceptance of the compliance of the approved factory building, whether it is constructed and built in accordance with the design drawings, and whether it meets the construction standards of the industrial zone. The main preparation documents are as follows:
5 copies of KOR NOR OR 02/5 application form for acceptance permit;
2. 5 copies of registration certificate and shareholder register (valid within 6 months);
3. Five copies of the legal representative's passport/work permit;
4. Five building permits;
5. Three copies of A1 architectural drawings;
2 sets of A3 architectural drawings;
The above documents shall be signed and stamped on each page (passport signature without stamp), and then submitted to IEAT for approval, with an approval time of 14 days.

Precautions:
1. If the registration certificate and shareholder register expire, they need to be updated before submission.
2. Construction shall be carried out according to the declared architectural drawings. If there are any changes, they must be applied for and reported. Otherwise, the architectural drawings need to be changed during the acceptance inspection, which will take time and effort to affect the project progress.
